Terms of Service

TERMS OF SALE AND AGREEMENT WITH SARAH WARRINGTON PHOTOGRAPHER

 

1. General Agreement

This agreement applies to the purchase and delivery of photography services, digital file downloads and photo canvas prints provided by Sarah Warrington Photographer (“Photographer”) to the purchaser (“Client”) as outlined below.

 

2. Copyright and Intellectual Property

The Photographer retains the full copyright and ownership of all images at all times. The purchase of digital files and/or canvas prints grants the Client a limited, non-exclusive, non-transferable personal license to use the image/s.

 

3. Permitted Personal Use

The Client is permitted to use the digital files and physical canvas prints for:

  • Personal display in the Client’s home or private spaces.

  • Sharing on personal, non-commercial social media accounts (e.g. Facebook, Instagram, personal blogs).

  • Printing the digital files for one-time personal use only.

 

4. Prohibited Uses

The Client may not use the digital files or canvas prints for:

  • Commercial use, monetary gain, or profit.

  • Sale, license, or distribution to third parties.

  • Entering into photographic competitions.

  • Altering, editing, or filtering the images (including applying social media filters) without written permission from Sarah Warrington Photographer.

  • Use in any paid marketing, advertising, or corporate campaigns.

 

5. Digital Files & Delivery

·         Production and Quality: High-resolution digital downloads will be provided based on the sizing and product requirement i.e. Kitchen Splashback, large-scale printing or photo print to fit a frame etc.

·         Delivery: Digital files will be delivered via a secure online link or email within 1-3 business days of placing your order and payment has been received in full.

 

6. Canvas Prints & Shipping

  • Production and Quality: Canvas orders are processed and printed by our professional lab partner based in New Zealand. Each canvas print is produced to the highest professional standard. Please note that colors, contrast, and brightness may vary slightly between your screen and the final printed canvas due to individual monitor settings.

  • Canvas prints are mounted on a wooden frame for instant hanging (taped and string included and mounted on back of canvas). The canvas material is a light and smooth finish - 110gsm. The canvas edge (sides) can either be white, black or image wrapped. Please select the option you prefer through the checkout process. Watermarks do not appear on final product/s.

  • Shipping Times: All physical canvas orders include shipping. Please allow 10 business days for production and delivery to your address. Tracking information will be provided once your artwork ships. Customers are responsible for ensuring the shipping address provided is correct. Reshipment fees for returned packages due to incorrect addresses will be passed on to the buyer. If you have entered your address incorrectly, please contact me within 2 days of placing your order this will avoid any further fees and any delivery delays and to update to the correct shipping address.

 

7. Additional Photography Services

Client Galleries: This is for a photo shoot particularly with pet photography or for a selection of digital files that exceeds 5 images.

You will receive a private, password-protected gallery and will remain action for 6 months from the delivery date. You are responsible for downloading and securing your digital files before the gallery expires. Do not share your password with unauthorized individuals.

 

8. Pricing & Payment

All prices are listed in NZD and are subject to change without notice.

A flat rate of $10.00 NZD (total) for shipping cost applies to all orders at checkout excluding digital file downloads.

Payment is required in full at the time the order is placed. Debit or credit card payments accepted via secure online portal (stripe). Orders will not be sent for printing until payment has successfully cleared.

No invoice is provided in the delivery package if sending as a gift with canvas prints.

Canvas print orders are for New Zealand addresses only. Overseas orders please contact me for a quote.

 

9. Returns & Damage Policy (Personal Clients)

  • Digital Downloads: All digital image sales are final and non-refundable due to the nature of downloadable products.

  • Canvas Prints: Due to the custom nature of print-on-demand products i.e. canvas or fine art printing Sarah Warrington Photographer does not accept returns, refunds or exchanges for change of mind.

  • Damaged Items: If your item is damaged during transit, please notify Sarah Warrington Photographer immediately within 5 days of delivery. Please provide clear photographs of the damage and the original packaging so we can file a claim and send a replacement if approved by our lab partner.

10. Limitation of Liability

The Photographer is not liable for print quality issues arising from files printed at outside laboratories chosen by the Client. The Photographer’s total liability for any claim or loss shall not exceed the total price paid by the Client.

 

11. Commercial Clients & Photographers

Any commercial use – including but not limited to resale, licensing, advertising, or brand promotion is strictly prohibited.
